GPSR Comes Into Effect: General Product Safety Regulation

On December 13, 2024, a new regulation will come into effect, affecting thousands of online sellers in Europe: the GPSR, or General Product Safety Regulation.

If you sell on marketplaces like Amazon, eBay, or Miravia, it’s crucial to understand how this regulation affects you and what steps you need to take to ensure your products comply with this new legislation.

What is the GPSR?

The GPSR is Regulation (EU) 2023/988 of the European Parliament and Council, aimed at enhancing the safety of non-food products sold in the European Union and the United Kingdom.

With the rise of online commerce and technological advances, the GPSR establishes clear standards to protect consumer health and safety, ensuring products meet stricter regulations. The GPSR requires manufacturers, importers, and distributors to adhere to new safety, traceability, and labeling standards, imposing additional responsibilities on marketplaces.

Which Products Does the GPSR Regulate?

The GPSR applies to all non-food products sold within the European Union, except for:

  • Medicines and veterinary products
  • Food, beverages, and animal feed
  • Plants and animals related to reproduction
  • Animal by-products and pesticides
  • Equipment managed by transport providers, aircraft, and antiques

What Do You Need to Sell Your Products Online in Compliance with the GPSR?

  • Manufacturer Information and Contact Details
    The name, address, and contact of the manufacturer or their representative in the EU.
  • Product Identification
    Display the following in your product gallery:

    • EAN or UPC codes
    • Compliance logos such as the CE mark
    • Safety warnings and the package weight
    • Real images of all sides of the packaging (infographics are not accepted)

What Happens If You Don’t Comply with the GPSR on Marketplaces?

If you fail to comply, your product listings will be deactivated on marketplaces such as Amazon or Miravia starting December 13, 2024.

Required Documentation for Amazon:

  • Manufacturer or EU representative data
  • Required documents according to the product category:
    • User guide
    • Patient data sheet
    • Supplier data sheet
    • Safety information
    • Instructions for use
    • Installation manual
    • User manual
  • Safety warnings and images: Provide images of the package and product showing the necessary information and warnings. Include a photo of the front, each side, and the back of the product.
  • Signed and stamped Declaration of Conformity.
